All capitalized terms used but not defined herein shall have the meaning ascribed to such term in the Conure Music Terms of Use and Privacy Policy.

CONURE CREDITS

Pursuant to the Conure Music Terms of Use, we may license Conure Credits to you for your use within the Services. Unless otherwise specified, Conure Credits shall be deemed an integral part of the Services. Conure Credits may be licensed both for a fee using “real money” and without any separate fee, such as when you are otherwise credited or awarded Conure Credits through the Services, from time to time. We may manage, regulate, control, modify or eliminate Conure Credits at any time, with or without notice to you. Conure Music shall have no liability to you or any third party in the event that Conure Music exercises any such rights.

REFUND POLICY

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT ANY PAYMENT FOR CONURE CREDITS IS FINAL AND NON-REFUNDABLE. CONURE MUSIC IS NOT REQUIRED TO PROVIDE A MONETARY REFUND FOR CONURE CREDITS, AND YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED CONURE CREDITS, UNLESS YOUR INABILITY TO USE YOUR CONURE CREDITS THROUGH THE SERVICES WAS CAUSED SOLELY BY THE NEGLIGENCE OR GROSS MISCONDUCT OF CONURE MUSIC.

Your purchase of Conure Credits also will be subject to the rules of your App Store provider. Conure Credits do not expire.

Your Account. You agree to pay all fees and applicable taxes incurred by you or anyone using your App Store account. We may revise the pricing for Conure Credits at any time. YOU ACKNOWLEDGE AND AGREE THAT CONURE MUSIC IS NOT REQUIRED TO PROVIDE A REFUND OF ANY KIND FOR ANY REASON, EXCEPT AS DESCRIBED IN THIS POLICY, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED CONURE CREDITS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.

Prices and Availability Subject to Change. Prices and availability of Songs offered through the Services are subject to change at any time. Conure Music does not provide price protection or refunds in the event of a price reduction or promotional offering. If technical problems prevent or unreasonably delay delivery of Songs through the Services, due to our negligence or gross misconduct, you must notify us at support@conuremusic.com. Your exclusive and sole remedy in this situation is a credit for the Conure Credits required to stream the Song via the Services, as determined by us in our sole discretion.

Risk of Loss. The data associated with your Conure Credits (whether purchased by you using Conure Credits or otherwise credited or awarded to you) is linked to your Device and therefore cannot be used on another device. Accordingly, any risk of loss of this data is transferred to you: (A) in the case of Conure Credits which you purchase from the App Store, as described in this Policy; and/or (B) in other cases, at the time Conure Credits are credited or awarded to you.
