Welcome to Conure Music ("Conure Music", "we", "us", "our"). This Privacy Policy applies to information collected through the Conure Music website (conuremusic.com) ("Site"), the Conure Music service, and any companion mobile application ("App") made available by Conure Music, Inc. (collectively, the "Services").

This Privacy Policy explains what information may be collected through the Services, how that information may be used or shared with others, how we safeguard that information, and how you may access or control its use in connection with our marketing communications and business activities. This Privacy Policy applies to all visitors, users, and others who access the Services ("Users"). All capitalized terms used but not defined herein shall have the meaning ascribed to such term in the Terms of Use.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the Services. By downloading, registering with, or using the Services, you agree to this Privacy Policy.

INFORMATION WE COLLECT

Information You Provide To Us

When you use the Services, for example to register for an Account, update your information, use certain features, request customer support or otherwise communicate with us, we or our service providers or business partners may collect information that could reasonably be used to contact you or identify you personally, such as your name, email address, telephone number, mobile phone number, birthday, location or payment/financial information ("Personal Information").

You may also share the following information with us:

You may decide to provide us with another person's email or phone number so that person may be provided with information about the Services or so that we may facilitate your communication with other people through the Services. You may also provide us with access to your address book if you use our Services to facilitate these connections. Your contacts will be provided with the option not to receive further communications from us.

Information Collected Automatically

Whenever you visit or interact with the Services, we may use a variety of technologies that automatically or passively collect information about how you access or use the Services ("Usage Information"). Usage Information may include your browser type, operating system, the page served, the time, and the preceding page views. However, this information does not identify you as an individual user. We do not treat Usage Information as Personal Information unless it is combined with other data that, once linked, can be used to identify you.

Device Identifiers. We may also automatically collect your IP address or other unique identifier ("Device Identifier") for the computer, mobile phone, technology or other device (collectively, "Device") you use to access the Services. A Device Identifier is a number that is automatically assigned to your Device when you access a web site or its servers, and our computers identify your Device by its Device Identifier. We may use a Device Identifier to, among other things, administer the Services, help diagnose problems with our servers, analyze trends, track Users' web page movements, or to help identify, and gather broad demographic information for aggregate use.

Location Information. We will notify you prior to the collection of location information and sharing of that information with third parties for analytics and advertising purposes. We will only collect information for these purposes with your explicit consent. If you initially consent to our collection of location information, you can subsequently stop the collection of this information at any time by going to the setting feature on your Device and changing your preferences. If you do so, certain features of our Services may no longer function. You also may stop our collection of location information by following the standard uninstall process to remove our Services from your Device. We will never collect or use the specific location of your Device (by using, for example, GPS or Bluetooth) without first getting your explicit permission. And if you choose to share location information but later change your mind, you will always have the ability to stop sharing.

Stored Information and Files. Only with your explicit permission, the Services may access metadata and other information associated with other files stored on your Device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information ("Storage Information and Files"). If you do not want us to collect Stored Information and Files or Location Information (as explained above), you may opt out by refusing to consent or revoking your permission under the "Settings" tab of your mobile device. You may disable consent previously granted at any time in the settings.

Cookies. A "cookie" is a file that websites send to a visitor's computer or other Internet-connected device to uniquely identify the visitor's browser or to store information or settings in the browser. Your browser may tell you how to be notified when you receive certain types of cookies or how to restrict or disable certain types of cookies. Please note, however, that without cookies you may not be able to use all of the features of the Services. When you use the Services, neither we nor any third parties collect Personal Information about your online activities, over time or across third party websites. We may collect information about you or your use of the Services through cookies, which lets us operate certain functions of the Services in line with the choices you make. These cookies mean that when you continue to use or to revisit the Services, we can provide you with various features (such as access to your Account) as you have asked for them to be provided. This could include remembering your username and/or password, remembering how you have customized our Services, or reminding you of content you have previously viewed.

Do Not Track. Currently the Services are not designed to respond to "Do Not Track" signals sent from your browser. For more information more about "Do Not Track," please visit www.allaboutdnt.org.

Mobile Identifiers. We may use software development kits ("SDKs") or mobile advertising identifiers (for example, "IDFA" on Apple mobile devices or "Advertising ID" on Android mobile devices), which function similarly to cookies on mobile devices. You may reset your IDFA or Advertising ID in the settings on your mobile device.

Information Received from Other Sources

We may receive information about you from our partners and service providers, (including, for example, business partners or analytics vendors) which we use to personalize your experience, to measure ad quality and responses, and to display ads that are more likely to be relevant to you.

We may obtain information from other sources and combine that with information we collect through the Services. For example, you may be able to create an Account on our Site by using your credentials from a third party social media site. Should you decide to do so, we will have access to certain information from that third party social media site, including but not limited to: your name, profile, account information, lists of your friends or followers, social activity, comments you have shared, groups, location or demographic information, in accordance with the authorization procedures determined by such third-party social media site.

Third Party Applications like Twitter and Facebook Connect give you the option to post about content you've seen or consumed on the Services to share with others. In addition, we may receive information about you if other Users of a Third Party Application or website gives us access to their profiles and you are one of their "connections" or information about you is otherwise accessible through your "connections" web page, profile page, or similar page on a social networking or other third party website or interactive service.

We may obtain information about you from other sources if you have given permission for such information to be shared. This may include information from public databases or data aggregators that may contain your demographic information, previous purchases, media consumption habits or lifestyle preferences.

HOW WE USE THE INFORMATION COLLECTED

We may use the information we collect about you or that we receive from other sources for a variety of purposes, including for example, to:

SHARING OF INFORMATION

The information collected or generated through your use of the Services may be shared by you or by us as described below.

Sharing of Information by You

When registering for an Account, you share your Personal Information such as your name, e-mail, and other additional information with us ("Registration Information"). Personal Information, such as your name or username may be viewable by other Users of the Services with whom you communicate.

Third Party Applications. If your Account is connected to a third party application or social media platform ("Third Party Applications"), we may automatically share your activity with that service or platform, including the content you view, download, purchase or use and such information may be attributed to your account on the Third Party Application and published on such service. This information may be publicly available through the Services or on the Third Party Application. For example, this may include your "Likes" and posts on Facebook. If you visit the Services while logged into the Third Party Application, then the Third Party Application may be able to identify your browser and associate the technical information provided by your web browser with other information that the Third Party Application already has about you. A Third Party Application's use of information collected from you (or as authorized by you) is governed by the Third Party Application's privacy policies and your settings on the relevant service.

User Content. You may share User Content through the Services or other Third Party Applications. Information about your activity on the Services, recently played songs or artists, your favorite songs or artists, and User Content that you post, upload, and/or share with other Users through the Services will be viewable only by those Users with whom you share it. Your activity on the Services (e.g., what you listen to) will automatically appear on the Services and will, for example, be accessible to other Users of the Services. Remember, if you post, upload, and/or share your User Content through a Third Party Application, it may be publicly available.

We may use your public information to promote the Services and to help others find and follow you and/or your content, including through Facebook and other Third Party Applications and on websites that embed the Services. Your information may be used to notify others, including within the Services, via email, and through Facebook and Third Party Applications, about your use of the Services (e.g., that you have joined the Services or activity related to your profile, such as listening to and sending or receiving content).

Sharing of Information by Us

We may share aggregate and anonymized User statistics, Registration Information, demographic information, and Usage Information with third parties. We may also share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy and in the following circumstances:

Marketing and Advertising. We may share information with advertisers in order to send you promotional communications about the Services or to show you more tailored content, including relevant advertising for products and services that may be of interest to you, and to understand how Users interact with advertisements. The information we share is a de-identified (for example, through the use of hashing) that does not personally identify you.

Service Providers. We may share your Personal Information with third parties that perform functions on our behalf ("Service Providers") to carry out your requests, respond to your inquiries or make various features of the Services available to you. These Service Providers may help us to host or operate the Services, analyze data, provide customer service, conduct marketing or administer surveys or questionnaires. We do not rent or sell the Personal Information you have provided to us unless we obtain your consent to do so.

Business Transfers. Your information may also be used by us or shared with our subsidiaries and affiliates for internal reasons, primarily for business and operational purposes. As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or all or substantially all of our assets, or assets related to the Services, your information may be disclosed to such entity as part of the due diligence process and will be transferred to such entity as one of the transferred assets. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.

Legal Disclosures. We may transfer and disclose your information to third parties to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our Terms of Use or other applicable policies; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of third parties.

YOUR PRIVACY CHOICES AND ACCESS

You may always direct us not to share your Personal Information with third parties, not to use your Personal Information to provide you with information or offers, or not to send you newsletters, updates, emails or other communications by visiting the "Settings" section of your Account at www.conuremusic.com or within your App.

In accordance with our routine record keeping, we may delete certain records that contain Personal Information that you have submitted through the Services. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups or other technology-related reasons.

If you opt-out of receiving promotional offers, we may still send you non-promotional communications, such as those about your Account or our ongoing business relations.

Your California Privacy Rights. California residents are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of personally identifiable information to third parties for their direct marketing purposes in the preceding calendar year (e.g., requests made in 2017 will receive information about 2016 sharing activities). We comply with this law by giving Users the ability to tell us not to share personally identifiable information with third parties for their direct marketing purposes. To make such a request, visit the "Settings" section of your Account at www.conuremusic.com or within your App. We may need additional information to process your request.

CHILDREN

The Services are not directed to children under 13. We do not knowingly collect Personal Information from anyone under 13 years of age. If we determine upon collection that a User is under this age, we will not use or maintain his/her Personal Information without the consent of a parent/guardian. LINKS TO OTHER WEBSITES

The Services may contain links to other sites, maintained by third parties. These links are provided only as a convenience to you. We have no control over, and are not responsible for any content, products or services offered by or found on third party sites, or their privacy policies. Links to third party sites do not constitute an assumption of liability for or sponsorship, endorsement or approval of these sites or the content contained on these sites.

SECURITY OF YOUR INFORMATION

We use certain reasonable security measures to help protect your Personal Information. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us. You provide us with your information at your own risk.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted through our Services. Any transmission of Personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

CHANGES

Any changes we may make to our Privacy Policy will be posted on this page and we will change the "Last updated" date, listed above, when we make changes. Check back frequently to see any updates or changes to our Privacy Policy. Your continued use of the Services after any modification to this Privacy Policy will constitute your acceptance of any such modifications. If you do not agree or consent to any updates or modifications, do not continue to use the Services.
